1Amending Title 61 (Prisons and Parole) of the Pennsylvania
2Consolidated Statutes, providing for private correctional
3facilities.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Title 61 of the Pennsylvania Consolidated
7Statutes is amended by adding a section to read:

8§ 1106. Private correctional facilities.

9(a) Prohibition.--No private correctional facility may be
10operated within this Commonwealth.

11(b) Continued operation.--Nothing in this section may
12prevent the continued operation of any private correctional
13facility that was in operation on the effective date of this
14section.

15(c) Definitions.--As used in this section, the following
16words and phrases shall have the meanings given to them in this
17subsection unless the context clearly indicates otherwise:

1"Private correctional facility." A for-profit correctional
2facility, prison or jail owned or operated by a private
3contractor contracting with the Commonwealth for the provision
4of correctional services. The term does not include a "community
5corrections facility" as defined under section 4701 (relating to
6definitions).

7Section 2. This act shall take effect immediately.
