Subject: Comprehensive Regulatory Reform
 
On February 6, 1996, Gov. Ridge signed Executive Order 1996-1, which reformed the regulatory review and promulgation process to reduce the amount of regulation in the Commonwealth; ensure regulations which are passed are actually necessary to address a compelling public interest; ensure meaningful input from political subdivisions and stakeholders, reduce burdensome regulations which have hampered the Commonwealth’s competitive edge; and ensure regulations are an appropriate and necessary means of protecting the public health and safety. The goal of this executive was to reduce the “red tape” of government. Gov. Rendell and Gov. Corbett both have not rescinded this Executive Order, showing bipartisan support.

Shortly, I will be introducing legislation to provide for these practices with in the Regulatory Review Act and further the scope of the executive to actually reduce red tape. My legislation will specifically require each agency to review existing regulation every 5 years (they may exclude any regulation adopted within the past 3 years) under new criteria. If an agency finds any regulation not in the public interest, the agency must provide recommended changes by using the following:
  • Less costly or intrusive methods
  • Minimize the adverse impact of the regulations on affected groups and persons by:
    • Less stringent compliance or reporting requirements
    • Less stringent schedules or reporting requirements
    • Consolidate or simplify compliance or reporting compliances
    • Establish performance standards
    • Exempt affected groups or persons
  • Recommend changes to the Governor or General Assembly
  • Repeal the Regulation
It also requires if a regulation was promulgated due to a Federal mandate, the regulation analysis shall be submitted to each member of the Congressional delegation.
