Over the past few years, we have seen an increase in the number of taxing jurisdictions looking to close budget gaps by enacting or increasing a non-resident earned income tax, often referred to as a “commuter tax.” When taxing jurisdictions were initially given the ability to enact a “commuter tax,” it was used to off-set the services utilized by those individuals who work in one area and live in another. Today we see taxing jurisdictions not utilizing the tax for this purpose but instead, using the tax to close gaps in their budgets. In the near future, I will be introducing legislation that will do two things. First, the legislation will prohibit all taxing jurisdictions from increasing any non-resident earned income tax that is currently imposed. Second, any taxing jurisdiction that does not have a non-resident earned income tax will be prohibited from enacted one. Both of these prohibitions will protect the citizens of the Commonwealth from increases in local taxation. I hope you will consider joining me in support of this important legislation.
