Subject: Small Games of Chance Act
 
In a bipartisan effort, we will introduce legislation amending Act 2 of 1988, known as the Local Option Small Games of Chance Act to change the distribution of proceeds formula and provide equal footing for entities with a retail licenses. Under the bill, the distribution of proceeds clubs and nonprofit charitable organizations may use for their general operating expenses will be increased from the current 30 percent allocation to 50 percent. In addition, the scope of the law is expanded to include entities with a retail license (organizations with a liquor license) so that these establishments may now offer small games of chances. In particular, the distribution of proceeds for the newly expanded organizations will maintain the 50 percent limit for general operating expenses and include additional distributions in the following manner:
  • Twenty percent of their weekly gross game revenue shall be donated to a charitable organization identified in the license application.
  • An assessment of fifteen percent shall be paid to the Commonwealth and dedicated specifically for Special Education Funding.
  • The remaining fifteen percent are to be provided to the municipality in which the retail license holder is located.
Our legislation sets out to accomplish three goals. First, addresses the issues raised by the clubs and nonprofits with respect to increasing the percentage of proceeds they are legally permitted to use for their general operating expenses under the Small Games of Chance Law. Second, it finally provides the legal ability for taverns and restaurants (retail license holders) to offer small games of chance in their facilities. This is an attempt to level the playing field with respect to all liquor licenses. Third, it increases charitable donations that ultimately help our communities and provides for an additional recurring revenue source for special education.
