MEMORANDUM

Posted: March 8, 2013 03:55 PM
From: Representative Steven J. Santarsiero
To: All House members
Subject: Reintroduce Former HB 2314 of 2011-12: Amend the Telemarketer Registration Act

Businesses of all sizes suffer from unwanted solicitation calls throughout the day. In the case of a small business, these calls are not only distracting but costly, as well. The day’s normal business becomes less efficient and the company’s profitability can be impacted. For these reasons, I will soon be reintroducing former HB 2314 of 2011-12.

For Pennsylvania, there are both national and state do not call lists for individuals. The national list is maintained by the Federal Trade Commission (FTC) and the Pennsylvania list is enforced by the Pennsylvania Attorney General's Bureau of Consumer Protection. Consumers are covered under current federal and state laws, but there are no provisions for business protection against unwanted calls.

My bill would amend Pennsylvania’s Telemarketer Registration Act of 1996 adding businesses in the act’s definitions so they would receive the same protection from unwanted calls as individual consumers do.
