Subject: Amending the Mortgage Licensing Act to Help Purchasers of Manufactured Housing
 
In the near future, I will be introducing legislation amending the Mortgage Licensing Act to help purchasers of manufactured housing.
 
Manufactured housing is the most affordable homeownership option available today and the largest form of unsubsidized affordable housing in the United States. It is also a critical affordable housing option for many families across the country, including some of America’s most financially vulnerable households.
 
However, Pennsylvania consumers interested in purchasing a manufactured home are often frustrated because they cannot secure financing or find answers to their most basic questions. This is because overly burdensome lending laws in Pennsylvania prohibit retail sellers of manufactured homes from answering basic customer questions about how to purchase and finance a home. Currently, if they want to answer these types of questions, they must be licensed as a loan originator, even if they have no intention of engaging in this financial activity.
 
In the near future, I plan to introduce language that will amend the Pennsylvania Mortgage Licensing Act by exempting manufactured home retail sellers and their employees from state licensing requirements, as long as they do not originate loans, provide financing, or receive any compensation or gain that depends on the financing of a manufactured home.
 
This clarification has already been made at the federal level through the Economic Growth, Regulatory Relief, and Consumer Protection Act (EGRRCP Act) in 2018. It’s now time to align the state law with the federal law.
