Subject: Student Suspension and Expulsion (Previous 1778)
 
I plan to re-introduce legislation to deal with the suspension and expulsion of students in the public schools. This bill would give school boards greater authority to suspend, expel or deny admission to transferring expelled students from other schools, and deny admission to a transferring student from another school for misconduct that would have subjected the student to expulsion at the receiving school. The district might also admit a student provisionally to its schools pending receipt of the transferring student’s disciplinary record. Curtailment of participation in the extracurricular activities program of a school district is one possible method of dealing with disruptive students. Conditions might also be imposed upon students seeking readmission to the district’s schools.

This legislation also contains provisions regarding a student’s due process right and proper notification of the family. Special education students shall enjoy the disciplinary protection provided by the federal Individuals with Disabilities Education Act. The Pennsylvania School Boards Association has been supportive of this bill.
