SUBJECT: Public School Code (Prior HB 1306)


In the near future, I will be reintroducing legislation (formally HB 1306) to repeal Sections 2502.48 & .49 of the Public School Code. This mandate reduces the flexibility of school districts to use their basic education funds to meet their individual needs; rather it requires school districts to spend the funding increase on areas included on the list in the school code. The menu of options set forth in the school code reflects the priorities of the people in Harrisburg, PDE and the State Board i.e. Ivory Palaces.

It is noted that this provision required school districts to start programs that were unsustainable without the continued massive infusion of funding. The Commonwealth and school districts are facing increased pressure on revenue collections and taxpayers are demanding a more effective and efficient use of taxpayer dollars.

While this requirement may not have an impact on current year funding, removing such a mandate reflects the philosophy of local control and increases future flexibility for the school districts.
