Subject: Tow Truck Liability (Former HB2596)
 
In the near future, I plan to re-introduce legislation (Former HB 2596) amending Act 110 of 2012, known as the Towing and Towing Storage Facility Standards Act.

My legislation will protect tow truck operators, who are properly summoned by law enforcement officers to remove vehicles under emergency situations from incurring any liability for damages to a vehicle while being towed.

Without this protection, vehicle owners/operators may sue tow truck companies for damages to their vehicle while the vehicle is being removed under emergency situations or due to lane blockage and/or a threat to public safety.

I believe it is appropriate to protect tow truck operators and companies who are removing vehicles in emergency situation; however, this protection is limited in cases involving gross negligence, willful or wanton misconduct or knowing misconduct that is present and physically observable. These provisions are not currently included under the act and would benefit and further protect tow truck operators and companies from being sued when in the course of emergency measures being employed through the legitimate exercise of their authority.
