Subject: | Auctioneer Licensing and Trading Assistant Registration Act |
I plan on re-introducing former HB2563 that would amend the Auctioneer Licensing and Trading Assistant Registration Act. This legislation will eliminate confusion and will update the law to better oversee modern business practices and arrangements now common in the auction profession. These changes continue the many consumer protections in the existing law and enable better enforcement of the law as a result of eliminating inconsistencies and clarifying definitions. Since 2009, the Pennsylvania Department of State, Bureau of Professional and Occupational Affairs ("BPOA") has pursued an aggressive and uneven enforcement regime under the Auctioneer Licensing and Trading Assistant Registration Act, 63 P.S. 734.1 et seq. (the "Act"). Ambiguities in the statutory language, and the absence of meaningful regulations, have facilitated enforcement activities that do not serve the purposes of the Act, and that have created uncertainty within the regulated community.
