Subject: Unfair Trade Practices Act - Low Cost Prescription Drugs (Prior HB1508)
 
In the near future, I will be re-introducing legislation that seeks to amend the Unfair Trade Practices Act with the intent of addressing the availability of low cost prescription drugs.

Over the course of recent years, it has been advertised by some retail outlets that generic versions of certain prescription drugs are available for as low as $4 for a 30 day supply. Unfortunately, legal staff representing these retailers has determined that due to the language established within the Unfair Trade Practices Act, prescriptions at this price are not permitted in Pennsylvania. Specifically, the Unfair Trade Practices Act does not permit the selling of a good under its actual value.

With this in mind, my legislation would amend the Unfair Trade Practices Act to correct this clause by allowing for such programs in Pennsylvania, as it relates to prescription drugs.
