Subject: Sunshine Act Amendment
 
I am planning to introduce legislation which will amend the Sunshine Act to allow agencies to discuss issues of safety, security and emergency preparedness in “executive session”.

Recent events have shown us that it is imperative for our schools and other government agencies to formulate, adopt, maintain and periodically update security measures in order to provide protection to our citizens. I believe it is essential that these agencies have the ability to thoroughly discuss issues of safety in a restricted forum to avoid jeopardizing the effectiveness of security measures which are ultimately put into place.

My bill will amend the Sunshine Act to incorporate language which is already a part of our state Right-To-Know Law. Specifically, my proposal will allow an agency to meet in executive session “to review and discuss agency business, the disclosure of which, if conducted in public, would:
  • be reasonably likely to result in a substantial and demonstrable risk of physical harm to or the personal security of an individual; or
  • create a reasonable likelihood of endangering the safety or the physical security of a building, public utility, resource, infrastructure, facility or information storage system.”
