MEMORANDUM

Posted: January 25, 2013 11:03 AM
From: Representative Curtis G. Sonney
To: All House members
Subject: Hazardous Facilities to Carry Liability Insurance

This legislation would require an owner or operator of a facility that uses or stores hazardous or toxic chemicals to maintain appropriate liability insurance, as well as establish penalties and fines.

Currently, facilities that utilize or store dangerous chemicals are only required to file information on the types of chemicals currently on the premises. In 2011 a biofuels plant in my district caught fire and put many lives in danger, caused chemical burns to firefighters and cost the fire company approximately $1.5 million in equipment damage.

Therefore, I’m introducing legislation to require these facilities to carry comprehensive liability insurance for the following;
*wrongful death
*personal injury
*property damage
*damage to the environment

This is a reintroduction of former HB 1806. Previous cosponsors include; BARBIN, D. COSTA, CREIGHTON, DeLUCA, FABRIZIO, FARRY, GEIST, GEORGE, GRELL, HALUSKA, HARKINS, MILLARD, MILLER, MILNE, QUINN, ROCK, VULAKOVICH and YOUNGBLOOD.

I appreciate your consideration and support. Please direct questions to Christine at; ccrone@pahousegop.com. Thank you.
