Please join me in cosponsoring legislation obliging nursing care facilities to meet the requirement that the resident care cost per diem is 95% or more of their Medicaid (MA) resident care component rate. Currently, if a facility does not spend MA resident care reimbursement funds on resident care, there are no consequences. Facilities spend these funds at their discretion. The General Assembly should hold nursing facilities accountable by ensuring that MA reimbursement funds specifically for resident care are actually spent on the provision of resident care by requiring that nursing facilities must spend 95% of their MA resident care rate on resident care. The state can easily assess whether a nursing facility meets the 95% spending requirement by comparing the facility’s quarterly MA resident care per diem rate to the facility’s per diem of resident care allowable costs for all residents reported in the annual cost report.
