Subject: | Health Club Act – Staffing Exception |
In the near future, I will introduce legislation amending the Health Club Act (No 87 of 1989). Act 106 of 2012 amended the Health Club Act by creating an exception to the requirement that trained staff must be on the premises during all hours of operation. Specifically, the 2012 amendment created an exception that allows smaller facilities to remain open without staff, provided the facility maintains certain automated safety equipment. I support this exception; however, I believe this exception should not be limited to smaller health clubs. I am introducing legislation which will put all health clubs on equal footing by creating a similar exception for larger facilities (over 6000 square feet). My legislation would require a larger facility seeking an employee exemption to have the following requisites for every 3,000 square foot portion of their facility:
These changes will allow for the staff exception for larger facilities that are currently being penalized. However, it will also provide more automated protections for these larger facilities. Please join me in cosponsoring this important legislation. |
