Subject: Minor’s Rights to Consent to Mental Health Treatment
 
In the near future, I plan to introduce legislation amending the act of February 13, 1970 (P.L. 19, No. 10), otherwise known as the Minor Consent to Medical, Dental, and Health Services Act, in order to give the Department of Public Welfare the ability to promulgate rules.

As many of you may know, the Minor Consent to Medical, Dental, and Health Services Act was amended by Act 147 of 2004 to add provisions regarding the rights of a minor, 14 years of age or older, to consent to outpatient mental health examination and treatment. Since its implementation, there has been much confusion among providers, minors, and parents regarding the rights of each party under the law. My bill amends Act 10 of 1970 in Section 1.1 (Mental Health Treatment) to give the Department of Public Welfare the authority to issue guidelines and adopt rules and regulations.

It is my hope that granting the Department the ability to provide guidance will resolve any uncertainties and ambiguities and provide uniform application presented by current Pennsylvania law.
