House of Representatives
Session of 2013 - 2014 Regular Session

MEMORANDUM

Posted: June 17, 2014 03:01 PM
From: Representative Matthew E. Baker
To: All House members
Subject: Regulating adult-oriented establishments in order to curb sex trafficking and other negative secondary effects

Our Commonwealth must make every effort to combat sex trafficking. Many helpful bills have been introduced on the subject, but this one is directed at the observation that “victims of trafficking are forced into various forms of commercial sexual exploitation including...stripping,” http://www.acf.hhs.gov/sites/default/files/orr/fact_sheet_sex_trafficking.pdf, that they “may start off dancing or stripping in clubs and then be coerced into situations of prostitution and pornography,” id., and that “strip clubs...are havens for prostitutes forced into sex trafficking,” http://www.fbi.gov/stats-services/publications/law-enforcement-bulletin/march_2011/human_sex_trafficking.

This bill would prevent adult-oriented establishments from being run by or employing those involved in sex trafficking or other crimes such as prostitution or exploitation of children. It would provide for information gathering and training for law enforcement and others who interact with potential victims to identify where sex trafficking may be occurring. The bill would also afford a mechanism for a victim of sex trafficking to bring a claim against an adult-oriented establishment where they were victimized. Additionally, this proposal would update our current law on adult-oriented establishments to limit some excesses in order to provide an environment less likely to create demand for trafficked persons.
