Subject: Amending the Liquor Code noise restrictions - Heffley
 
In the near future I plan to introduce legislation to amend the Pennsylvania Liquor Code.

My legislation would exempt licensees within an historic district from the Liquor Code's noise restrictions. Licensees located in historic districts throughout the Commonwealth are at a distinct disadvantage when forced to comply with the Liquor Code's noise restrictions. These licensees are located in historic buildings that are not soundproofed, and they are incapable of making the changes necessary to their locations in order to comply with the Liquor Code's noise restrictions. The licensee's only option is to not have any form of musical entertainment on the licensed premises or risk receiving a citation from the Bureau of Liquor Control Enforcement.

My legislation does not prevent the local municipality, which is the government entity I believe should be enacting noise ordinances, from enacting an ordinance within which these licensees would have to come into compliance.
