Subject: Co-Sponsorship - Increase DUI Penalties
 
I plan to re-introduce legislation from last session, HB 1388, that would increase the current DUI penalty structure in Title 75 (Vehicles). My proposed changes are to 3rd and 4th time offenders for the .10 to .159 percent tier and to the .16 percent and higher tier 2nd and 3rd time offenders, as well as adding for 4th time offenders.

  • Under the BAC of .10 to .159 percent tier
* The 3rd offense penalty changes include:
- Increase fine from the current $1,500-$10,000 range to a range of $5,000-$10,000.
- The current mandatory ignition interlock penalty would increase from 1 to 2 years.
* The 4th and subsequent offense penalty changes include:
- Increasing grade of penalty from a 1st degree misdemeanor to a 3rd degree felony.
- Increase fine from current $1,500-$10,000 range to a range of $10,000-$15,000.
- Increasing license suspension from 18 to 24 months.
- Increasing current mandatory ignition interlock penalty from 1 to 5 years.
  • Under the BAC of .16 percent and higher
* A new penalty would be added to the first offense to now include a mandatory 1 year
ignition interlock.
* The 2nd offense penalty changes include:
- Increasing the fine from current $1,500 to a range of $5,000-$10,000.
- Increasing mandatory ignition interlock from 1 to 2 years.
* The 3rd offense penalty changes include:
- Increasing grade from a 1st degree misdemeanor to a 3rd degree felony.
- Increasing fine from current $2,500 to a range of $10,000-$15,000.
- Increasing the license suspension from 18 to 24 months.
- Increasing the current mandatory ignition interlock from 1 to 5 years.
* Legislation would add a penalty for the 4th and subsequent offense to include:
- Penalty would be graded as a 2nd degree felony
- A 2 year minimum imprisonment
- Fine would be $15,000-$20,000
- 36 month license suspension
- Mandatory ignition interlock for life
