Subject: Establishing the Landowner Bill of Rights
 
In the near future, I will introduce legislation that will direct the Office of the Attorney General to create a Landowner Bill of Rights in cases where a property is condemned and /or under eminent domain authority.
 
Presently, PA laws regarding compensation and due process for property acquired under such circumstances is often difficult to locate and understand by property owners.  
 
The Attorney General’s office should ensure that proper notification and rights of the individual property owner are not forfeited due to a lack of information and communications on the part of the commonwealth. 
 
The Landowner Bill of Rights will state that the property owner must be notified of the following rights:
  1. Notice of the proposed acquisition of the owner's property
  2. Just compensation and other damages for the property condemned
  3. A hearing to determine just compensation and measure of damages
  4. An appeal of a judgment in a condemnation proceeding
 The property owner's bill of rights shall be provided to the last known address of the property owner at least seven days before an agency's declaration of taking.
