Subject: Protecting the Rights of Concealed Carry Permit Holders Traveling Across State Lines
 
Under current Pennsylvania statute, law enforcement personnel outside the Commonwealth may use the Firearms License Validation System to inquire about a Pennsylvania license to carry and will receive information such as the name of the licensee, the validity of the license, and any information which may be provided to a criminal justice agency pursuant to Chapter 91 of Title 18.

Some states that do not have reciprocity agreements with Pennsylvania have been misusing their authority when it comes to information available regarding out-of-state concealed carry permit holders. There have been instances in these states of law-abiding Pennsylvanians being detained for lengthy periods of time during traffic stops.

My legislation will amend Title 18 to clarify that information from the Firearms License Validation System may not be provided to personnel in another state that has NOT entered into a reciprocity agreement with the Commonwealth of Pennsylvania.

This proposal mirrors similar legislation that recently became law in Virginia.
