SUBJECT: Armed Forces Recruiter Access to Student Recruiting Information (Prior HB 2710)

In the near future, I plain to reintroduce legislation (formally HB 2710) repealing the Act of June 27, 1991 (P.L. 70, No. 10), Updating existing legislation to complement the Federal No Child Left Behind Act of 2001.

As it stands, Act 10 of 1991 requires superintendents to make available, upon request by armed forces recruiters, access to a list of senior male and female students by name, address and, if published, telephone number. In 2001, the Federal No Child Left Behind Act was passed, with section 9528 titled Armed Forces recruiters access to secondary school students’ names, addresses, and telephone listings. As interpreted by the Pennsylvania Department of Educations, “secondary school students” refers to juniors and seniors.

To maintain uniformity between federal and state statues, I am proposing this legislation. My proposal will rewrite existing legislation, changing access to recruiters to include both juniors and seniors from all school entities and licensed private or nonpublic schools. As is included in Act 10 of 1991, each student shall be notified of the release of their information, and each school entity and licensed private or nonpublic school must comply with written requests to be excluded from such access to recruiters.

It is necessary to repeal Act 10 of 1991 and replace it with legislation that compliments the Federal No Child Left Behind Act.
