| In the near future, I will reintroduce legislation amending Act 442 of 1967 (Open Space Preservation) broadening the categories of real property which may be exempted from millage increases to include real property subject to agricultural conservation easements acquired through nonprofit land trusts. Currently, land preserved through the State Agricultural Conservation Easement Purchase Program (Act 43 of 1981) is eligible for exemption from further millage increases if the governing body of each taxing district that imposes a tax on the property agrees to provide the exemption. Since the enactment of the “tax freeze” provision in 2006, it has been implemented within certain municipalities in several counties. Other taxing authorities have expressed interest in providing an exemption, but may wish to include farmland preserved through programs other than the statewide farmland preservation program. This legislation will make farmland preserved by private land trusts eligible for a millage freeze.
