Subject: Small Games of Chance Re-write
 
Since the passage of Acts 2 and 184 of 2012 (Small Games of Chance), there has been a lot of confusion as to the differences between liquor and non-liquor licensees. In the near future, I will be introducing a bill to clarify this.

My legislation is a comprehensive re-write of the Act. Because of so much confusion between groups with a liquor license and those without, separate chapters have been created for these separate groups. All the licensing standards and recordkeeping/reporting requirements are specifically stated for each type of organization under their section. Provisions include:

Eligible organizations --- NO LIQUOR LICENSE
  • Allows an eligible organization to conduct punchboards, pull tabs, raffles, daily drawings, weekly drawings, 50/50 drawings, selective raffles, poker runs, coin auctions, race night games and vertical wheel games.
  • Removes all prize limit restrictions.
  • Changes that organizations making less than $5000 in a year do not have to file annual reports (current law), submit background checks (current law), or keep a separate bank account;
Clubs ---- LIQUOR LICENSEES
  • Allows an eligible organization to conduct punchboards, pull tabs, raffles, daily drawings, weekly drawings and 50/50 drawings.
  • Removes all prize limit restrictions.
  • Provides that 60% of proceeds are for public interest purposes, 30% of proceeds for general operating expenses of the club and 10% of the proceeds to the county in which the club is licensed;
  • Requires a club licensee to file with the county a report monthly.

My bill also includes many of the provisions of House Bill 290 which was passed by the House earlier this session.

This bill should end the confusion between liquor and non-liquor licensees in regard to small games of chance, assist our counties with additional funding, and allow our organizations to remain a viable part of our communities.
