Subject: | Protecting Consumers from Unfair Debt Collection |
In the near future, I plan to introduce legislation which will amend the Fair Credit Extension Uniformity Act (FCEUA) by requiring debt collectors and creditors to provide a consumer with written verification of any alleged debt which they are attempting to collect. Additionally, they shall also include notification if the debt is too old to be lawfully enforced under the statute of limitations. By clarifying the law under this proposal, we can ensure that consumers are being provided the right information about any debts being sought against them. With information such as this, consumers have the added ability to make informed decisions on how to respond to any claim. It is important to note that nothing in this bill would prevent anyone from collecting what they are owed, and nothing prevents any creditor from filing a lawsuit for collection if they so choose. |
