I intend to reintroduce Senate Bill 452 of 2011, legislation that will establish the “Integrated Water Resources Restoration, Protection and Management Act,” to expand storm water planning throughout the Commonwealth. Many areas of the Commonwealth are subject to flooding due to drainage and storm water runoff. These may be longstanding problems or relatively new problems caused by recent development. The current law, the “Storm Water Management Act,” was aimed at addressing issues prospectively from the adoption of the act (1978), but was not intended to address pre-existing problems (or indirect results). This legislation is intended to address existing problems, link and maintain storm water facilities and provide assessments against property owners to pay for necessary improvements. The “Integrated Water Resources Restoration, Protection and Management Act” will expand the storm water planning requirements to be undertaken by counties; authorize the formation of water resources management authorities; provide for the development of integrated water resources management plans; and impose powers and duties on the department of Environmental Protection, the Environmental Quality Board, counties, municipalities and water resources management authorities. |
