Subject: | Amending Unfair Sales Act (Previous HB 653) |
In the near future, I will be re-introducing legislation that seeks to amend the Unfair Sales Act to exempt applicability for the sale of prescription and non-prescription drugs and make medication more affordable to consumers. This legislation was previously introduced as HB 653 (2013-2014.) Recently, some retail outlets have advertised the sale of generic versions of certain prescription drugs are available for as low as $4 for a 30 day supply. Unfortunately, Pennsylvania law does not permit the advertisement or sale of prescription or non-prescription drugs at or below cost as this practice violates the Unfair Sales Act. Specifically, this Act prohibits the sale of merchandise for less than its actual value. My legislation will amend the Unfair Sales Act to exempt the sale of prescription or non-prescription drugs, at wholesale or retail, from the provisions of the Act and permit advertisements and sales of medication at prices that may be more affordable to consumers throughout the Commonwealth.
