In the near future, I will introduce two bills to provide for disclosure and notification of former methamphetamine labs in residential properties. Methamphetamine (meth) is an illegal, highly addictive synthetic drug produced for illicit use. Often, it is made inside apartments and homes and, while this knowledge is troubling; it becomes even more concerning when you learn that meth production creates hazardous wastes that can cause chronic illness. Residual contamination may be in the plumbing, walls, floors and ceilings; not readily seen. One of my bills addresses disclosure to tenants in residential rental units. This legislation amends the Landlord Tenant Act to require that if a landlord has actual knowledge that a unit previously was used as a meth lab, the landlord must provide written notice before execution of a written lease. If there is no written lease, the landlord must notify the tenant before occupancy takes place. If a tenant does not receive the notification as required above, the tenant may terminate the lease, in writing, within 60 days of finding out that the property was used as a meth lab. The other bill amends Title 68 regarding seller disclosure. The legislation adds “previous use of premises as a methamphetamine lab” to the list of conditions that must be included in the seller disclosure statement. Both bills define “methamphetamine lab” as “an area where methamphetamine, or its immediate precursors, have been or were attempted to be manufactured, processed, cooked, disposed of or stored and all proximate areas likely to be contaminated as a result of such manufacturing, processing, cooking, disposing or storing.” *(NOTE: Please sign on to both bills) CS:CG:cmc |
