Subject: Amendment to the provisions for the election of officers in cases of vacancy by resignation in Second Class Townships
 
In the near future I plan on introducing legislation updating the vacancy procedures for Second Class Townships. Currently the Second Class Township Code does not provide a specific procedure to address vacancies created as the result of a resignation. As a result there is sometime confusion as to when the vacancy is created, and as a result the supervisors are not clear when the thirty days to fill a vacancy begins.

My legislation sets for a specific plan to address vacancies by resignation, indicating that a vacancy shall not be created immediately by a resignation but after acceptance of it by the majority vote of the board of supervisors of the township. Such acceptance of the resignation must occur no later than 45 days after it has been tendered by the township’s officer. Finally, the section 407 is reorganized to make the process of filling vacancies easier to understand
