Recent news reports indicating that employers in the U.S. and other nations have begun implanting employees with radio frequency identification (RFID) microchips is alarming to say the least. While a number of these reports indicate that the implantation is voluntary, volunteering to receive an RFID chip is the beginning of a very slippery slope. Given privacy and public health concerns surrounding RFID implantation, I intend to introduce legislation that would prohibit the unauthorized implantation of an RFID microchip in a human being. Specifically, it would be an offense under the Crimes Code for an individual, business entity, governmental entity, or any other organization or association to implant an RFID microchip in an individual without written authorization from the individual. According to NCSL, at least 19 states have approved some form of RFID privacy law. Four of these states have enacted laws prohibiting implantation of RFID microchips, and the others have enacted legislation to prohibit unauthorized skimming of RFID cards, limit the use of RFID information on driver's licenses, and/or prohibit the monitoring of students through RFID technology. The approval of such laws in 19 states indicates that privacy concerns surrounding this technology are growing.
