Subject: Prohibiting Health Care Provider Self-Referrals
 
As legislators we need to protect consumers from referrals within the health care system that are motivated by interests other than what is best for the patient. Specifically we need to guard against health care providers self-referring.

A self-referring scheme is designed to direct a patient to a facility which would provide financial gain to the referrer.

My legislation will take the current prohibition for certain physician referrals (self-referrals) that exists for Pennsylvania’s workers compensation system, and extend it to the rendering of all medical services.

Specifically, a health care provider may not refer a person for a designated health service if the provider or an immediate family member of the provider has a financial interest with the person or entity that receives the referral.

A health care provider also may not enter into an arrangement or scheme, such as a cross-referral arrangement, which the health care provider knows or should know has a principal purpose of assuring referrals of designated health services by a health care provider to a particular entity which would provide gain.

Last session this was HB 600.
