Subject: | Protecting Pennsylvanians Living with Pre-Existing Conditions |
The current membership of the United States Supreme Court presents a very real possibility that the Affordable Care Act (ACA) could be struck down and its provisions protecting the right to health care for every American would no longer exist. Included in what would disappear is the protection that prohibits insurers from denying or excluding health care coverage for an individual based on any pre-existing health conditions. Stripping away such protection would lead to millions of Pennsylvanians being denied insurance coverage because of pregnancy, cancer, illness or any other pre-existing condition. This is not a history lesson, but rather a brewing and potential crisis. There have been repeated attempts at using the courts to repeal the ACA and the Supreme Court continues to hear cases concerning the ACA’s legal existence. We can preserve the pre-existing condition protection in the instance that the entire ACA is invalidated by the courts by passing a law. I strongly believe we should prohibit health insurers from using an individual’s pre-existing medical condition to deny or exclude coverage under a health insurance policy.
