MEMORANDUM

Posted: December 20, 2022 11:37 AM
From: Representative Melissa L. Shusterman
To: All House members
Subject: Civil Recourse for “Stealthing”

Tragically, individuals throughout our state and nation have been the target of sex crimes for which they have no recourse. The nonconsensual removal of a condom during sexual intercourse or the nonconsensual tampering of a condom places victims at risk of pregnancy and sexually transmitted infections. This act, commonly known as “stealthing,” is a form of assault that our laws do not address.

Therefore, we plan to introduce legislation that will allow victims to have the opportunity to file a civil action suit against a person who engaged in stealthing. California recently passed legislation combatting this problem, making it the first state to do so. We must do the same as we advocate for those who are harmed by stealthing and hold those accountable who commit this atrocious act.

Please join us in better protecting individuals subjected to unintended pregnancy or sexually transmitted infections as a result of stealthing.

Introduced as HB918
