Subject: Increased Penalties for Driving Offenses in Work Zones
 
In the near future I will be introducing legislation which would increase penalties for driving offenses in active work zones.

According to the Bureau of Labor Statistics, approximately 123 construction workers die each year in collisions that occur in active construction sites and thousands more are seriously injured.  The Pennsylvania Vehicle Code is comprised of many existing moving violations and penalties but it is time we do more to protect our roadside construction workers.

My legislation will impose penalties according to the following schedule:
  • 1st Infraction
    • 2 points on the offender’s license
    • $400 fine
    • Mandatory completion of a PennDOT driver safety course.
  • 2nd Infraction
    • 90-day driver license suspension
    • $800 fine
    • Mandatory completion of a PennDOT driver safety course.
  • 3rd Infraction
    • 1-year driver license suspension
    • $1200 fine
    • Mandatory completion of a PennDOT driver safety course.
While this legislation is partially a preventative effort to deter unsafe driving, it will also increase penalties for injuring a worker or damaging construction equipment as follows:

  • 6-month driver license suspension
  • Mandatory completion of a PennDOT driver safety course.
Any revenue from these penalties would be disbursed as follows:

  • 50% shall be allocated for the implementation of PennDOT’s driver safety course.
  • 50% shall be allocated to reimburse the investigating law enforcement agency.
