In the near future, I plan to introduce legislation that will allow parents and legal guardians to have access to their child’s medical records. In Pennsylvania, a minor who is fourteen years of age or older may consent to their own mental health treatment, the consent of the minor’s parent or legal guardian is not required. Additionally, the law gives minors full control regarding the release of those treatment records. This means the minor is the only one who can give consent for the release of their medical records to their parent or legal guardian. Concerned parents who want to know about the health, safety and well-being of their child should have the ability to access medical records without needing consent from their minor child. This legislation does not change the age of consent, nor does it take away the ability of a minor to consent to treatment, it merely grants parents and/or legal guardians access to their minor child’s medical records.
