AMENDMENTS TO HOUSE BILL NO. 201

1Amend Bill, page 1, line 2, by inserting after "Statutes, "

2in general provisions, further providing for definitions
3and providing for charging Internet convenience fee; and

4Amend Bill, page 1, lines 6 and 7, by striking out all of
5said lines and inserting

6Section 1. Section 103 of Title 62 of the Pennsylvania
7Consolidated Statutes is amended by adding a definition to read:

8§ 103. Definitions.

9Subject to additional definitions contained in subsequent
10provisions of this part which are applicable to specific
11provisions of this part, the following words and phrases when
12used in this part shall have the meanings given to them in this
13section unless the context clearly indicates otherwise:

15"Internet convenience fee." An additional fee for an online
16transaction of an executive agency, including, but not limited
17to, a fee for ordering an online search or an online filing of
18any application, license, permit, registration or form, if the
19fee is separate from and in addition to the fee for the same
20search, application, license, permit, registration or form when
21the transaction is made in person or by mail. The term shall
22also include any additional online fee for a person to use a
23credit card, debit card or electronic transfer from a checking
24account in paying for an online search or an online filing of
25any application, license, permit, registration or form.

27Section 2. Title 62 is amended by adding a section to read:

28§ 109. Internet convenience fee.

29No contract pursuant to this title shall authorize and no
30executive agency is permitted to establish any Internet
31convenience fee without specific authorization from the General
32Assembly. This limitation shall not preclude any type of credit
33card or debit card processing fee for the payment of any type of
34tax or fee to the Department of Revenue or the Pennsylvania
35Public Utility Commission or for the payment of any fine or
36penalty to an executive agency.

37Section 3. Section 513(e) of Title 62 is amended to read:
