                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for scattering
     3     rubbish.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 6501(a)(3) and (b)(5) of Title 18 of the
     7  Pennsylvania Consolidated Statutes are amended to read:
     8  § 6501.  Scattering rubbish.
     9     (a)  Offense defined.--A person is guilty of an offense if
    10  he:
    11         * * *
    12         (3)  is the owner or operator, or an agent of either, of
    13     a [trash, garbage or debris collection] vehicle[, including
    14     private automobiles and small trucks, or any other type of
    15     vehicles] used [to collect or transport], for profit or not
    16     for profit, in the collection or transportation of trash,
    17     garbage or debris, who knowingly causes to be deposited or

     1     deposits the vehicle's load or any part thereof upon any
     2     road, street, highway, alley or railroad right-of-way, or
     3     upon the land of another or into the waters of this
     4     Commonwealth.
     5     (b)  Penalty.--

     7         (5)  Any vehicle, equipment or conveyance, including any
     8     private automobile and small truck, may be deemed contraband
     9     and forfeited in accordance with the provisions set forth in
    10     this section if it is used for the transportation or disposal
    11     of trash, garbage or debris:
    12             (i)  in an amount exceeding 25 pounds, in the
    13         commission of an offense under subsection (a)(3); or
    14             (ii)  in any amount, in the commission of a second or
    15         subsequent offense under subsection (a)(3) [may be deemed
    16         contraband and forfeited in accordance with the
    17         provisions set forth in this section].

    19     Section 2.  This act shall take effect in 60 days.
