                                     AN ACT

     1  Requiring State heating systems to be fueled by coal.

     2     The General Assembly of the Commonwealth of Pennsylvania
     3  hereby enacts as follows:
     4  Section 1.  Definitions.
     5     The following words and phrases when used in this act shall
     6  have the meanings given to them in this section unless the
     7  context clearly indicates otherwise:
     8     "Coal."  Coal produced from mines in this Commonwealth or any
     9  mixture or synthetic derived, in whole or in part, from coal
    10  produced from mines in this Commonwealth.
    11     "Mixture derived, in whole or in part, from coal."  Includes,
    12  but is not limited to, both the intermittent and the
    13  simultaneous burning of natural gas with coal or a coal
    14  derivative if the intermittent or simultaneous burning of
    15  natural gas would:
    16         (1)  lower the cost of using coal or a coal derivative


     1     produced from mines in this Commonwealth; or
     2         (2)  enable coal or a coal derivative produced from mines
     3     in this Commonwealth to be burned in compliance with present
     4     and reasonably anticipated environmental laws and
     5     regulations.
     6  Section 2.  State heating systems to be fueled by coal.
     7     Any heating system or heating unit installed in a facility
     8  owned by the Commonwealth or by a State-related university on or
     9  after the effective date of this act shall be fueled by coal.
    10  Section 3.  Exceptions.
    11     Any heating system or heating unit shall be exempt from the
    12  requirement of section 2 if the Secretary of General Services
    13  determines that:
    14         (1)  using coal as the fuel for that heating system or
    15     heating unit would violate existing or reasonably anticipated
    16     environmental laws or regulations;
    17         (2)  using coal as the fuel for that heating system or
    18     heating unit would not be cost effective when compared to
    19     using other forms of energy;
    20         (3)  the principal fuel for that heating system or
    21     heating unit would be natural gas from wells located in this
    22     Commonwealth or wood from forests located in this
    23     Commonwealth; or
    24         (4)  the heating system or heating unit was in or beyond
    25     the design stage prior to the effective date of this act.
    26  Section 4.  Reports to General Assembly.
    27     The Secretary of General Services shall report to the House
    28  Committee on Mines and Energy Management and the Senate
    29  Committee on Environmental Resources and Energy the basis for
    30  any determination that a heating system or heating unit shall be

     1  exempt from the requirement of section 2.
     2  Section 5.  Effective date.
     3     This act shall take effect in 60 days.
