                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," further providing for
     4     regulations as to assistance, for establishment of RESET and
     5     for grant diversion.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 403 of the act of June 13, 1967 (P.L.31,
     9  No.21), known as the Public Welfare Code, is amended by adding a
    10  subsection to read:
    11     Section 403.  Uniformity in Administration of Assistance;
    12  Regulations as to Assistance.--* * *
    13     (b.1)  The department shall seek waivers from the Federal
    14  Government, if needed, to ensure that recipients earn minimum
    15  wage.

    17     Section 2.  Sections 405.1(c) and 405.5(i), amended or added
    18  May 16, 1996 (P.L.175, No.35), are amended to read:
    19     Section 405.1.  Establishment of RESET.--* * *

     1     (c)  No applicant or recipient subject to the requirements of
     2  subsection (a.2) shall refuse to accept a bona fide offer of
     3  employment or training.
     4     In order to be a bona fide offer of employment, there must be
     5  reasonable assurances that:
     6     (1)  Appropriate standards for the health, safety, minimum
     7  wage and other conditions applicable to the performance of work
     8  and training in the employment are established and will be
     9  maintained.
    10     (2)  The offer of employment will not result in any
    11  displacement of employed workers.
    12     (3)  With respect to such employment, the conditions of work,
    13  training, education, and employment are reasonable in the light
    14  of such factors as the type of work, geographical region, and a
    15  proficiency of the participant.
    16     (4)  The employment is not available due to labor dispute,
    17  strike or lock-out.
    18     (5)  The applicant or recipient is classified as an employe
    19  as defined under section 104 of the act of June 2, 1915
    20  (P.L.736, No.338), known as the "Workers' Compensation Act."

    22     Section 405.5.  Grant Diversion.--* * *
    23     (i)  An employer may terminate the employment of a
    24  participating recipient at any time[.], Provided, That, the
    25  recipient is terminated only for cause and is afforded the right
    26  to a hearing upon notice of termination. The department may deem
    27  ineligible for participation in the grant diversion program any
    28  employer that consistently terminates the employment of
    29  participating recipients during or soon after the end of the
    30  grant diversion period.
