AN ACT
1 Amending Title 66 (Public Utilities) of the Pennsylvania
2 Consolidated Statutes, further providing for alternative form
3 of regulation of telecommunications services.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Sections 3004(d) and 3006(c) of Title 66 of the
7 Pennsylvania Consolidated Statutes are amended by adding
8 paragraphs to read:
9 § 3004. Commission review and approval of petition and plan.

11 (d) Criteria for commission review.--The commission shall
12 approve the petition, after notice and hearing, only if it finds
13 that the petition meets the following criteria:

15 (16) Prohibits the local exchange company from
16 increasing the rates for any protected service for any
17 customer or class of customers in any year by a greater
18 percentage than the overall percentage increase allowed under
1 the alternative form of regulation in that year.

3 § 3006. Streamlined form of rate regulation.

5 (c) Commission review.--The commission shall review a
6 streamlined form of rate regulation for a local exchange
7 telecommunications company within nine months of the filing of
8 the petition. If the commission does not act within nine months
9 of the filing of the petition, the plan shall be deemed
10 approved. The commission shall approve a streamlined form of
11 rate regulation for a local exchange telecommunications company
12 upon reaching the following findings:

14 (5) The proposal prohibits the local exchange
15 telecommunications company from increasing the rates for any
16 protected service for any customer or class of customers in
17 any year by a greater percentage than the overall percentage
18 increase allowed under the streamlined form of regulation in
19 that year.

21 Section 2. Title 66 is amended by adding a section to read:
22 § 3010. Local exchange telecommunications company subject to
23 alternative or streamlined form of rate regulation.
24 Any local exchange telecommunications company which is
25 subject to an alternative form of regulation or streamlined form
26 of regulation under this chapter may not, after the effective
27 date of this section, increase the rates for any protected
28 service for any customer or class of customers in any year by a
29 greater percentage than the overall percentage increase allowed
30 under the alternative or streamlined form of regulation in that

1 year.
2 Section 3. This act shall take effect immediately.
