        INTRODUCED BY CAWLEY, TIGUE, GEORGE, LEDERER, FICHTER, CURRY,
           CAPPELLI, HARHAI, PRESTON, THOMAS, ROBERTS, DONATUCCI,
           HORSEY, McCALL, PISTELLA, JOSEPHS, READSHAW, CRUZ, MELIO,
           GRUCELA, SCRIMENTI, KELLER, WANSACZ, HENNESSEY, SOLOBAY,
           LAUGHLIN AND TANGRETTI, FEBRUARY 18, 2003

        REFERRED TO COMMITTEE ON RULES, FEBRUARY 18, 2003

                                  A RESOLUTION

     1  Directing the Committee on Environmental Resources and Energy to
     2     hold public hearings on the disposal of 500,000 tons of
     3     battery casings and contaminated soil in the Borough of
     4     Throop, Lackawanna County, Pennsylvania.

     5     WHEREAS, Marjol Battery manufactured batteries in Throop,
     6  Lackawanna County, Pennsylvania; and
     7     WHEREAS, As a result of many years of manufacturing
     8  batteries, a serious lead contamination problem exists; and
     9     WHEREAS, Five hundred thousand tons of battery casings and
    10  contaminated soil exist on the former site of Marjol Battery;
    11  and
    12     WHEREAS, The Environmental Protection Agency (EPA) presented
    13  a plan for cleanup which would leave most of the lead waste on
    14  the Marjol site and bury it under an impermeable ten-acre cap;
    15  and
    16     WHEREAS, United States Senator Arlen Specter, United States
    17  Representative Don Sherwood and State Representative Gaynor


     1  Cawley are determined to see a total cleanup of Marjol that is
     2  consistent with public health concerns; therefore be it
     3     RESOLVED, That the Committee on Environmental Resources and
     4  Energy of the House of Representatives hold public hearings in
     5  Harrisburg, the Borough of Throop and any other place the
     6  committee deems appropriate, to gather facts and determine if
     7  legislation is necessary to address the public health concerns
     8  about 500,000 tons of battery casings and contaminated soil
     9  existing at the former Marjol Battery site in Throop Borough,
    10  Lackawanna County, Pennsylvania.
