AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, further providing for liability for
3 reimbursement of costs for outside counsel.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 5303(a) of Title 18 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 5303. Liability for reimbursement of costs for outside
9 counsel.
10 (a) General rule.--A public official who is convicted of a
11 felony or a misdemeanor under Federal law or under the laws of
12 this Commonwealth shall be liable for and shall reimburse any
13 public money expended by the Commonwealth to:
14 (1) cover the costs incurred by an agency for outside
15 counsel to defend the convicted public official in connection
16 with a criminal investigation and prosecution of such public
17 official[.]; and
1 (2) cover the costs reasonably incurred by an agency for
2 outside counsel to defend the interests of the agency or its
3 other employees in connection with a criminal investigation
4 and prosecution of such public official.
