        REFERRED TO COMMITTEE ON RULES, APRIL 10, 1989

                                  A RESOLUTION

     1  Memorializing Congress to intercede to protect the public from
     2     the ruling of the Federal Communications Commission allowing
     3     indecent programming on television between 12 midnight and 6
     4     a.m.

     5     WHEREAS, The Federal Communications Commission, on November
     6  24, 1987, ruled that it would allow indecent programming on
     7  television between the hours of 12 midnight and 6 a.m.; and
     8     WHEREAS, Indecent programming, while not legally obscene, is
     9  nonetheless in violation of the provision of Federal law
    10  pertaining to broadcasting which provides: "Whoever utters any
    11  obscene, indecent or profane language by means of radio
    12  communication shall be fined not more than $10,000 or imprisoned
    13  for not more than two years, or both"; and
    14     WHEREAS, The FCC acted in such a fashion as to usurp the
    15  power of Congress by simply granting this permission to
    16  broadcast indecent material; therefore be it
    17     RESOLVED, That the House of Representatives of the


     1  Commonwealth of Pennsylvania memorialize Congress to intercede
     2  to protect the viewing public from this intrusion of indecency
     3  into their living rooms by enforcing the Federal law and
     4  reversing the FCC ruling.
