           MELIO, FARGO, ACOSTA, JACKSON, R. C. WRIGHT, TIGUE, DALEY,
           McCALL, SERAFINI AND MICHLOVIC, JANUARY 23, 1989

        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           MARCH 14, 1989

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further regulating the carrying of
     3     loaded firearms in a vehicle; and making a technical change.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 6106.1.  Carrying loaded WEAPONS OTHER THAN firearms.           <--
     9     (a)  General rule.--No person shall carry a loaded pistol,
    10  revolver, shotgun or rifle, regardless of barrel length OTHER     <--
    11  THAN A FIREARM AS DEFINED IN SECTION 6102 (RELATING TO
    12  DEFINITIONS), in any vehicle.
    13     (b)  Exceptions--The provisions of subsection (a) THE          <--
    14  PROVISIONS OF THIS SUBSECTION shall not apply to:                 <--
    15         (1)  Persons licensed to carry firearms under section
    16     6109 (relating to licenses).
    17         (2)  Persons PERSONS excepted from the requirement of a    <--


     1     license to carry firearms under section 6106(b)(1), (2), (5)
     2     or (6) (relating to firearms not to be carried without a
     3     license).
     4     (c) (B)  Penalty.--A person who violates the provisions of     <--
     5  this section commits a summary offense.
     6     Section 2.  Section 6119 of Title 18 is amended to read:
     7  § 6119.  Violation penalty.
     8     [An] Except as otherwise specifically provided, an offense
     9  under this [section] subchapter constitutes a misdemeanor of the
    10  first degree.
    11     Section 3.  This act shall take effect in 60 days.
