| AN ACT |
| |
1 | Establishing a system for payment or reduction in payment for | <-- |
2 | preventable serious adverse events within this Commonwealth; |
3 | and providing for the powers and duties of the Department of |
4 | Health and the Department of State. |
5 | Establishing a system for payment or reduction in payment for | <-- |
6 | preventable serious adverse events within this Commonwealth; |
7 | developing bulletins; and providing for the powers and duties |
8 | of the Department of Public Welfare, the Department of Health |
9 | and the Department of State. |
10 | The General Assembly of the Commonwealth of Pennsylvania |
11 | hereby enacts as follows: |
12 | Section 1. Short title. |
13 | This act shall be known and may be cited as the Preventable |
14 | Serious Adverse Events Act. |
15 | Section 2. Definitions. |
16 | The following words and phrases when used in this act shall |
17 | have the meanings given to them in this section unless the |
18 | context clearly indicates otherwise: |
19 | "Health care facility." A health care facility as defined |

1 | under section 802.1 of the act of July 19, 1979 (P.L.130, No. |
2 | 48), known as the Health Care Facilities Act, or an entity |
3 | licensed as a hospital under the act of June 13, 1967 (P.L.31, |
4 | No.21), known as the Public Welfare Code. |
5 | "Health care provider." A health care facility or a person, |
6 | including a corporation, university or other educational |
7 | institution, licensed or approved by the Commonwealth to provide |
8 | health care or professional medical services. The term shall |
9 | include, but not be limited to, a physician, a certified nurse |
10 | midwife, a podiatrist, a certified registered nurse |
11 | practitioner, a physician assistant, a chiropractor, a hospital, |
12 | an ambulatory surgery center, a nursing home or a birth center. |
13 | "Health payor." An individual or entity paying for health |
14 | services for himself or itself or on behalf of another. |
15 | "Medical assistance." The Commonwealth's medical assistance |
16 | program established under the act of June 13, 1967 (P.L.31, No. |
17 | 21), known as the Public Welfare Code. |
18 | "National Quality Forum." A not-for-profit membership |
19 | organization created to develop and implement a national |
20 | strategy for health care quality measurement and reporting. |
21 | "Preventable serious adverse event." An event that occurs in |
22 | a health care facility that is within the health care provider's |
23 | control to avoid, but that occurs because of an error or other |
24 | system failure and results in a patient's death, loss of body |
25 | part, disfigurement, disability or loss of bodily function |
26 | lasting more than seven days or still present at the time of |
27 | discharge from a health care facility. Such Unless the events | <-- |

29 | issued by the Department of Public Welfare under section 4(a) or |
30 | with respect to medical assistance hospital payments under |

1 | section 7(a) and (b), such events shall be within the list of |
2 | reportable serious events adopted by the National Quality Forum. |
3 | "Principal." A principal shall mean a nursing facility or | <-- |
4 | trade association representing nursing facilities. |
5 | Section 3. Payment policy for preventable serious adverse |
6 | events. |
7 | (a) General rule.--Health care providers may not knowingly | <-- |
8 | seek payment from health payors, or patients for a preventable |
9 | serious adverse event or services required to correct or treat |
10 | the problem created by such an event when such an event occurred |
11 | under their control. |
12 | (a) General rule.--A health care provider may not knowingly | <-- |
13 | seek payment from a health payor or patient: |
14 | (1) for a preventable serious adverse event; or |
15 | (2) for any services required to correct or treat the |
16 | problem created by a preventable serious adverse event when |
17 | that event occurred under their control. |
18 | (b) Refunds.--A health care provider who discovers that |
19 | payment has unknowingly been sought for a preventable serious |
20 | adverse event or services required to correct or treat the |
21 | problem created by such an event shall immediately notify the |
22 | health payor, or patient and shall refund any payment received |
23 | within 30 days of discovery or receipt of payment, whichever is |
24 | later. |
25 | (c) Notification.--A health care payor who discovers that |
26 | payment has been sought for a preventable serious adverse event |
27 | or services required to correct or treat a problem created by |
28 | such an event shall notify the health care provider that payment |
29 | may not be sought for such an event or services and that payment |
30 | shall not be made for such events or services. |

1 | (d) Liability.--Any information provided to any health care |
2 | payor or health care provider, in compliance with subsections |
3 | (b) and (c), shall not be discoverable or admissible in any |
4 | civil or administrative action related to the act of March 20, |
5 | 2002 (P.L.154, No.13), known as the Medical Care Availability |
6 | and Reduction of Error (Mcare) Act. |
7 | Section 4. Nursing facility preventable serious adverse events | <-- |
8 | bulletin. |
9 | (a) Nursing facility bulletin.--The Department of Public |
10 | Welfare shall issue a preventable serious adverse events |
11 | bulletin for nursing facilities. For a nursing facility, |
12 | preventable serious adverse events shall be those listed in a |
13 | bulletin developed by the department under this section. |
14 | (b) Consulting principals.--Prior to issuance of a bulletin, |
15 | the Department of Public Welfare shall consult with principals |
16 | concerning the development of a preventable serious adverse |
17 | events bulletin for nursing facilities. |
18 | (c) Open meetings.--Meetings held under subsection (b) shall |
19 | be open to the public. |
20 | (d) Publication.--The Department of Public Welfare shall |
21 | publish the proposed preventable serious adverse events bulletin |
22 | in the Pennsylvania Bulletin and solicit public comments for a |
23 | minimum of 30 days. After consideration of the comments it |
24 | receives, the Department of Public Welfare may proceed to adopt |
25 | the final preventable serious adverse events bulletin by |
26 | publication in the Pennsylvania Bulletin. The Department of |
27 | Public Welfare shall include its responses to the public |
28 | comments that it received concerning the proposed bulletin. |
29 | (e) Department notice.--The Department of Public Welfare |
30 | shall notify the Department of Health of the final preventable |

1 | serious adverse events bulletin published under this section. |
2 | Section 45. Duties of Department of Health. | <-- |
3 | (a) Publishing of updates.--The department shall publish in | <-- |
4 | the Pennsylvania Bulletin any updates to the list of reportable |
5 | serious adverse events adopted by the National Quality Forum |
6 | within 30 days of the update issued by the National Quality |
7 | Forum. |
8 | (a) Publishing of updates.--The Department of Health shall | <-- |
9 | publish in the Pennsylvania Bulletin: |
10 | (1) Any updates to the list of reportable serious |
11 | adverse events adopted by the National Quality Forum within |
12 | 30 days of the update issued by the National Quality Forum. |
13 | (2) A citation to the preventable serious adverse events |
14 | the bulletin published under section 4. |
15 | (b) Health department responsibility.--In accordance with |
16 | the act of July 19, 1979 (P.L.130, No.48), known as the Health |
17 | Care Facilities Act, the Department of Health shall be |
18 | responsible for investigating patient or health payor complaints | <-- |
19 | regarding a health care facility that is seeking payment |
20 | directly from the patient or health care payor for a preventable |
21 | serious adverse event. |
22 | Section 56. Duties of Department of State. | <-- |
23 | The Department of State shall be responsible for |
24 | investigating patient complaints regarding a health care |
25 | provider that is not a health care facility that is seeking or |
26 | causing to be sought payment directly from the patient or health |
27 | care payor for a preventable serious adverse event. |
28 | Section 67. Applicability. | <-- |
29 | (a) Hospital medical assistance payment policy.--Nothing in | <-- |
30 | this act shall require the Department of Public Welfare to |

1 | alter, amend or reissue any payment policy for inpatient |
2 | hospitals relating to preventable serious adverse events that |
3 | was promulgated prior to the enactment of this act. Any |
4 | modifications to the Department of Public Welfare payment policy |
5 | promulgated on or after the date of enactment of this act for a |
6 | health care provider for a preventable serious adverse event |
7 | shall require a 30-day public comment period. |
8 | (b) |
9 | (a) Hospital preventable serious adverse events bulletin.-- | <-- |
10 | Nothing in this act shall require the Department of Public |
11 | Welfare to alter, amend, revise or reissue any preventable |
12 | serious adverse events bulletin relating to inpatient hospitals |
13 | issued prior to the effective date of this act. |
14 | (b) Comment period.--Any modifications to the Department of |
15 | Public Welfare preventable serious adverse events bulletins |
16 | issued after the effective date of this act for a health care |
17 | provider for a preventable serious adverse event shall require a |
18 | 30-day public comment period. |
19 | (c) Contracts.--Nothing in this act shall prohibit a health |
20 | care provider and payor from establishing by contract any |
21 | policies and procedures associated with serious preventable |
22 | adverse events necessary to implement the provisions of this |
23 | act. |
24 | (c)(d) Reporting.-- | <-- |
25 | (1) Health care providers shall include all applicable | <-- |
26 | medical codes in making reports in compliance with the act of |
27 | July 8, 1986 (P.L.408, No.89), known as the Health Care Cost |
28 | Containment Act. |
29 | (1) Except for health care providers under section 4, | <-- |
30 | health care providers shall include all applicable medical |

1 | codes in making reports to the Health Care Cost Containment |
2 | Council. |
3 | (2) A preventable serious adverse event shall be |
4 | reported pursuant to the requirements of the act of March 20, |
5 | 2002 (P.L.154, No.13), known as the Medical Care Availability |
6 | and Reduction of Error (Mcare) Act. |
7 | (d)(e) Medicare payment.--Nothing in this act shall be | <-- |
8 | construed to supersede Medicare payment policies where the |
9 | services provided to the patient are paid for by Medicare. If |
10 | Medicare denies payment based on a determination that a |
11 | preventable serious adverse event has occurred, nothing in this |
12 | act shall be construed to require medical assistance, any other | <-- |
13 | department responsible for payment of a medical claim or a |
14 | health payor to pay a claim for the event or services. |
15 | (f) Department initiation.--Nothing in this act may prevent | <-- |
16 | the Department of Public Welfare from developing, revising or |
17 | amending a preventable serious adverse events bulletin in |
18 | consultation with health care providers. |
19 | (g) Consultation by Department of Public Welfare.--Nothing |
20 | in this act may prevent the Department of Public Welfare from |
21 | consulting with any other agency or department that is |
22 | responsible for payment of medical claims submitted for payment |
23 | by a health care provider. |
24 | Section 78. Effective date. | <-- |
25 | This act shall take effect in 180 days.as follows: | <-- |
26 | (1) Section 4 shall take effect in one year. |
27 | (2) The remainder of this act shall take effect in 60 |
28 | days. |
