           THOMAS, WATSON, WRIGHT AND YOUNGBLOOD, JANUARY 25, 2005

        REFERRED TO COMMITTEE ON ENVIRONMENTAL RESOURCES AND ENERGY,
           JANUARY 25, 2005

                                     AN ACT

     1  Authorizing the Department of Conservation and Natural
     2     Resources, the Department of Transportation and the
     3     Department of Environmental Protection on behalf of the
     4     Commonwealth to agree to hold and save the United States Army
     5     Corps of Engineers free from certain damages arising from
     6     certain construction projects.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9  Section 1.  Hold harmless.
    10     The Department of Conservation and Natural Resources, the
    11  Department of Transportation and the Department of Environmental
    12  Protection, acting for and in the name of the Commonwealth, is
    13  authorized to agree to hold and save the United States Army
    14  Corps of Engineers free from all damages arising from
    15  construction, operation and maintenance of projects along the
    16  Delaware Canal State Park, and projects in the Boroughs of
    17  Stockertown and Tatamy and the Township of Palmer located in
    18  Northampton County, involving cooperative agreements between the
    19  Commonwealth and the United States Army Corps of Engineers,

     1  except for any damages due to the fault or negligence of the
     2  United States Army Corps of Engineers.
     3  Section 2.  Effective date.
     4     This act shall take effect immediately.
