AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, further providing for a restriction on
3 the privilege of operating a motor vehicle.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. The heading and subsection (a) of section 6310.4
7 of Title 18 of the Pennsylvania Consolidated Statutes are
8 amended to read:
9 § 6310.4. Restriction of operating [privileges] privilege.
10 (a) General rule.--Whenever a person is convicted or is
11 adjudicated delinquent or is admitted to any preadjudication
12 program for a violation of section 6307 (relating to
13 misrepresentation of age to secure liquor or malt or brewed
14 beverages), 6308 (relating to purchase, consumption, possession
15 or transportation of liquor or malt or brewed beverages) or
16 6310.3 (relating to carrying a false identification card), the
17 court, including a court not of record if it is exercising
1 jurisdiction pursuant to 42 Pa.C.S. § 1515(a) (relating to
2 jurisdiction and venue), shall order the operating privilege of
3 the person suspended[. A] and shall order the immediate
4 surrender of the person's driver's license. The surrendered
5 license and a copy of the order shall be transmitted to the
6 Department of Transportation.
