                                     AN ACT

     1  Amending the act of July 16, 1968 (P.L.351, No.173), entitled,
     2     as amended, "An act authorizing the establishment of prisoner
     3     pre-release centers and release plans under the jurisdiction
     4     of the Department of Justice and defining its powers and
     5     duties," further providing for the establishment of rules and
     6     regulations.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 3 of the act of July 16, 1968 (P.L.351,
    10  No.173), referred to as the Prisoner Pre-release Plan Law,
    11  amended December 2, 1970 (P.L.832, No.274), is amended to read:
    12     Section 3.  Establishment of Rules and Regulations;
    13  Penalties.--(a)  The [Bureau of Correction] Department of
    14  Corrections shall establish rules and regulations for granting
    15  and administering release plans and shall determine those
    16  inmates who may participate in any plan.
    17     (b)  Any rules or regulations established by the department
    18  under subsection (a) shall include a provision which requires
    19  any employer participating in a work release plan to notify any


     1  customer of the business that it employs persons on work
     2  release, if the work agreement between the employer and the
     3  customer involves work which will be conducted or performed
     4  within the customer's residence prior to the performance of the
     5  work.
     6     (c)  If any inmate violates the rules or regulations
     7  prescribed by the [bureau] department, his release privileges
     8  may be withdrawn. Failure of any inmate to report to or return
     9  from the assigned place of employment, training, education or
    10  other authorized destination shall be deemed an escape under the
    11  provisions of section 309 of the act of June 24, 1939 (P.L.872),
    12  known as "The Penal Code."
    13     Section 2.  This act shall take effect in 60 days.
