        AS AMENDED ON THIRD CONSIDERATION, IN SENATE, FEBRUARY 2, 1998

                                     AN ACT

     1  Amending the act of August 9, 1955 (P.L.323, No.130), entitled
     2     "An act relating to counties of the third, fourth, fifth,
     3     sixth, seventh and eighth classes; amending, revising,
     4     consolidating and changing the laws relating thereto,"
     5     FURTHER DEFINING "PERMANENT RESIDENT"; AND authorizing         <--
     6     counties to make appropriations to municipal corporations for
     7     disaster or emergency aid.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Article XIX of the act of August 9, 1955           <--
    11  (P.L.323, No.130), known as The County Code, is amended by
    12  adding a subdivision to read:
    13     SECTION 1.  THE DEFINITION OF "PERMANENT RESIDENT" IN SECTION  <--
    14  1770.2(F) OF THE ACT OF AUGUST 9, 1955 (P.L.323, NO.130), KNOWN
    15  AS THE COUNTY CODE, ADDED JUNE 18, 1997 (P.L.179, NO.18), IS
    16  AMENDED TO READ:
    17     SECTION 1770.2.  AUTHORIZATION OF EXCISE TAX.--* * *


     1     (F)  AS USED IN THIS SECTION, THE FOLLOWING WORDS AND PHRASES
     2  SHALL HAVE THE MEANINGS GIVEN TO THEM IN THIS SUBSECTION:

     4     "PERMANENT RESIDENT."  A PERSON WHO HAS OCCUPIED OR HAS THE
     5  RIGHT TO OCCUPANCY OF A ROOM OR ROOMS IN A HOTEL AS A PATRON OR
     6  OTHERWISE FOR A PERIOD EXCEEDING [SIXTY] THIRTY CONSECUTIVE
     7  DAYS.

    11  AMENDED TO READ:

    21     SECTION 3.  ARTICLE XIX OF THE ACT IS AMENDED BY ADDING A
    22  SUBDIVISION TO READ:

    24               SPECIAL POWERS AND DUTIES OF COUNTIES

    26          (g.1)  Disaster-Emergency Aid to Municipalities
    27     Section 1948.  Emergency Appropriation to Municipal
    28  Corporations.--(a)  The board of county commissioners of any
    29  county may appropriate money from the county's operating reserve
    30  fund, created and maintained in accordance with section 513 of
    19970H0109B2852                  - 2 -

     1  this act, for the purpose of assisting municipal corporations
     2  within the county with any cleanup, maintenance, repair and
     3  improvements undertaken as a result of damage incurred or a
     4  dangerous condition caused by either a disaster emergency within
     5  the county declared by the Governor or a local emergency
     6  declared by the governing body of a municipal corporation within
     7  the county.
     8     (b)  As used in this section:
     9     "Disaster emergency" shall have the meaning ascribed to the
    10  term in 35 Pa.C.S. § 7102 (relating to definitions).
    11     "Local emergency" shall have the meaning ascribed to the term
    12  in 35 Pa.C.S. § 7102 (relating to definitions).
    13     Section 2 4.  This act shall take effect in 60 days.           <--
