HOUSE BILL

No. 122 Session of 1989


        INTRODUCED BY LESCOVITZ, JAROLIN, RYBAK, LASHINGER, BORTNER,
           CAWLEY, TRELLO, DALEY, HERMAN, COY, COLAIZZO, COLAFELLA,
           PRESTON, VEON, REBER, BELARDI AND BISHOP, JANUARY 25, 1989

        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           OCTOBER 3, 1989

                                     AN ACT

     1  Authorizing the Governor to appoint commissioners SECRETARY OF    <--
     2     TRANSPORTATION to negotiate an interstate compact with states
     3     adjoining this Commonwealth concerning maintenance and repair
     4     of public highways, transportation facilities and rights-of-
     5     way on or along state lines.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8  Section 1.  Authority of Governor.                                <--
     9     The Governor is hereby authorized to designate three officers  <--
    10  of the Commonwealth as commissioners with power THE SECRETARY OF  <--
    11  TRANSPORTATION IS AUTHORIZED to negotiate a compact with the
    12  duly authorized agents of any one or more of the States of
    13  Delaware, Maryland, New Jersey, New York, Ohio and West Virginia
    14  in accordance with the Constitution of the United States,
    15  concerning maintenance and repair of public highways,
    16  transportation facilities and rights-of-way situated on or along
    17  the line between the Commonwealth and any of the states
    18  enumerated above, whereby the Commonwealth and any of these


     1  other states mutually agree to maintain and repair those
     2  portions of such public highways, transportation facilities and
     3  rights-of-way as are situated within their respective
     4  jurisdictions.
     5  Section 2.  Submission to General Assembly for ratification.
     6     The compact negotiated by said commissioners THE SECRETARY OF  <--
     7  TRANSPORTATION shall be submitted by the Governor to the General
     8  Assembly and shall become immediately operative as to the
     9  Commonwealth and such other states as ratify it whenever it has
    10  been ratified by a duly enacted law of this Commonwealth, and by
    11  any other states as their laws may prescribe, and the Congress
    12  of the United States has, if required, consented thereto.
    13  Section 3.  Effective date.
    14     This act shall take effect immediately.
